Two men charged in $3,000 retail theft from Lululemon in Upper Dublin, police say

Two men from New York are facing charges after they allegedly conspired to steal $3,000 worth of pants from the Lululemon on Market Street.

Upper Dublin Police have filed charges against two men from Bronx, NY, alleging they conspired to steal more than $3,000 worth of merchandise from the Lululemon on Market Street.

Paul Henderson II, 53, and Carlos Nieves, 47, have both been charged with felony conspiracy counts of retail theft and receiving stolen property, stemming from an alleged theft from the store on March 30. Nieves also faces felony counts of retail theft and receiving stolen property, court records show.

According to the affidavit of probable cause, Nieves was driven to the store by Henderson, at which point Nieves entered the store, opened a black duffle bag that he had brought inside with him, and proceeded to place 24 pairs of men’s pants before exiting the store without paying. Nieves then placed the stolen merchandise into the back of Henderson’s vehicle and the two drove away, police said.

The total value of the stolen pants was $3,072, according to charging documents.

Investigators said the vehicle was observed on surveillance outside the store, and they were able to trace the registration to Henderson. Additionally, the affidavit states that Henderson and Nieves were arrested together for shoplifting in Hoboken, NJ on March 10.

Court records show charges were filed against both men on May 22, with Henderson being taken into custody on June 17 and arraigned by Magisterial District Judge Todd Barnes, who set bail at $10,000 unsecured. His next court appearance is a preliminary hearing on July 12 at noon in front of Magisterial District Judge Douglas Lavenberg.

Nieves has not been taken into custody, and there is an active warrant for his arrest.
