Toll Brothers, the Fort Washington-based homebuilder, has initiated legal action against the owner of a defunct golf course in Boca Raton, Florida, according to the Philadelphia Business Journal.
The lawsuit, filed on Jan. 31, 2025, in U.S. District Court in West Palm Beach, seeks to enforce a sales agreement for the 55-acre property formerly known as Hidden Valley Golf Course, located at 7601 E. Country Club Blvd.
In February 2024, Raelynne "Rae" Kolter, president of the Miami-based Boca Raton Executive Country Club Corp. (BRECC), signed a sales agreement with Toll Southeast, a Toll Brothers affiliate, to sell the property. The agreement underwent five amendments, with the latest extending the inspection period through December 31, 2024. Despite these modifications, BRECC has reportedly declined to honor the sales agreement and proceed with the transaction.
Toll Southeast's lawsuit seeks specific performance, aiming to compel BRECC to fulfill the terms of the sales agreement. Additionally, the homebuilder has filed a lis pendens on the property, placing a hold on its title to prevent any sale during the ongoing litigation.
This legal action underscores Toll Brothers' strategic interest in acquiring and developing former golf course properties in Florida. Notably, in August 2023, the Parkland City Commission approved a contract with Toll Brothers to purchase 21 acres of the former Heron Bay Golf Course for the development of up to 52 luxury homes.
